Judgment enforcement in 2016 reached positive results

On 28 October 2016, under the authorization of the Prime Minister, Minister of Justice Le Thanh Long presented a statement on the result of judgment enforcement in 2016 to the 14th National Assembly (NA) during the parliament’s second session.
Speaking at the plenum, Minister of Justice Le Thanh Long said that in 2016, the Government actively directed the activity of civil judgment enforcement, enforcement of civil decision in criminal judgments and administrative judgment enforcement assigned under Resolution No. 111/2015/QH13. In addition, the implementation of private bailiff according to Resolution No. 107/2015/QH13 was well performed. With these results, it can be said that the judgment enforcement activity had a positive change, better protecting legitimate rights and interests of citizens and contributing to ensuring security, safety and order of the society.
In 2016, civil judgment enforcement agencies nationwide had to execute 821,216 cases, in which 675,429 had condition to enforce, with the rate of 82.25 per cent. Accordingly, civil judgment enforcement agencies completely executed 530,428 cases, with the rate of 78.53 per cent. Regarding enforcement of cases related to credit and banks, the system has completed 3,348 cases, collecting VND 19,654 billion.
According the statement presented by Minister Le Thanh Long, in 2016, the task of professional guide and direction was also a good one. Thus, 209 out of 217 proposals were resolved with the rate of 96.31per cent. Through the activity of summarizing problems and drawbacks in practice, the Ministry of Justice and the Ministry of National Defense has promptly issued guidelines and directions to uniformly implementation of laws and regulation in this field. In addition, the collaboration between the Ministry of Justice, the Supreme People’s Court, the Supreme People’s Procuracy, the State Bank of Vietnam, the Ministry of Public Security and others were very close to deal with long lasting and complicated cases.
Besides the above results, Minister of Justice Le Thanh Long frankly stated some backlogs and problems of this activity in 2016. Accordingly, there have been a huge number of cases, which had full condition to execute but have not been finished. What is more, the development of legal normative docuement guiding the implementation of the Law on Civil Judgment Enforcement (amended) has not ensured the agenda. Real estate market had not had many obvious changes, making low results of asset disposal; and the auction still faced difficulties, he added.
In terms of the implementation of Resolution No. 107/2015/QH13 on private bailiff, the Prime Minister has issued a plan to implement the Resolution. The Ministry of Justice in collaboration with ministries, ministerial level agencies and localities organized a national conference to fully grasp and implement the Resolution and to guide People’s Committees to implement the Resolution. Moreover, the Government has been focusing on drafting a decree amending and supplementing Decree No. 61/2009/ND-CP and Decree No. 135/2013/ND-CP.
In the time to come, in order to improve this activity, Minister Le Thanh Long proposed the NA continue focusing on improving the institutions related to judgment enforcement activities and creating unify and synchronized legal framework for this activity. At the same time, the NA should direct concerned ministries, branches and local committees to effectively implement Resolution No. 107/2015/QH13 on private bailiff. In addition, the NA should allocate budget adequately and ensure working facilities for the system nationwide.
Minister of Justice also recommended that the NA, delegations of the National Assembly, People's Councils, the Fatherland Front at all levels will strengthen supervision within its competence, especially thematic monitoring focusing on a number of cases facing difficulties while executed related to collaboration between concerned agencies.
On the same day, Chief Justice of the Supreme People’s Court Nguyen Hoa Binh, Prosecutor General of the Supreme People's Procuracy Le Minh Tri and Minister of Public Security To Lam and Inspector General of the Government Inspectorate Phan Van Sau presented statements related to operation of each agencies. After that, NA deputies spent the remaining of the day to discuss at the plenum these above reports./.
